Martynenko facilitated Russian company Skoda JS in winning tenders in Ukraine with the help of fake competitors

Czech company with Russian roots Skoda JS a.s. won tenders of the state enterprise NNEGC Energoatom for the supply of equipment for nuclear power stations with the help of fake competitors. According to evidence presented by anti-corruption prosecutors in court, former MP Mykola Martynenko facilitated them. Payoffs from such tenders were transferred to MP’s offshore accounts.

On February 11, the regular court hearing in the case against former MP Mykola Martynenko was held in Shevchenkivskyi Court of Kyiv. The court investigated documents regarding procurements of equipment by the state enterprise NNEGC Energoatom from the Czech company Skoda JS a.s..

The court investigated documents regarding 6 contracts signed with Skoda JS a.s. for the total amount of 6.4 million UAH.

In the court hearing the prosecutor Roman Symkiv stated that, according to results of all these contracts, Skoda JS a.s. transferred part of payment to Panama company Bradcrest Investment S.A.

The owner of latter, as it had already been investigated in court, is Mykola Martynenko.

Czech company received 5 out of 6 contracts, which were studied in court, according to results of open bidding. Studied in court documents confirm that Skoda JS a.s. won tenders of the state enterprise NNEGC Energoatom due to conspiracy with the related companies.

For instance, Proatom LLC, acting as the competitor of Skoda JS a.s., submitted tender documents which it had received from Skoda JS a.s. itself.

So, Proatom LLC submitted certificates of Skoda JS a.s. regarding availability of employees and specialists of the related qualification, documents on having the experience in performing similar works and other documents.

The above-mentioned facts indicate that the company Skoda JS a.s. applied for the tender “directly” and via the company Proatom and other pseudo-competitors.

Moreover, offers submitted by both Skoda JS a.s. and Proatom did not meet requirements of the tender itself. According to the Law, such tenderers’ offers should be rejected. The State Audit Service confirmed it in its conclusions.

After the conclusion of contracts, Skoda JS a.s. involved Proatom LLC for executing contracts’ terms as the subcontracting party.

Also, during the hearing it became known that payment by results of procurement was conducted at the expense of credit funds from Czech Export Bank for 85% with 5-year deferral.

In the middle of the hearing the court was forced to announce break, because one of the accused subjects, namely Ruslan Zhurylo, suddenly left the courtroom for the smoking break without any requests and warnings.

The next court hearing will be held on February 19 at 9.00.
