Court of Appeal Refused NABU in Access to the Secret E-declarations of the State Security Service

On May 12 the Appellate Court of Kyiv abolished decision of first instance court that granted NABU access to e-declarations of staff members of the State Security Service.

As a result, NABU is limited in its capacity to investigate corruption-related crimes of top management of the State Security Service.

In 2016 the State Security Service of Ukraine adopted an unlawful decision to allow its staff members, including top management, to submit e-declarations into special closed registry instead of open public registry, as provided by the law on prevention of corruption.

The NAPC failed  to implement necessary measures to ensure that declarations of the State Security Service are submitted according to the law. As a result, neither NAPC nor NABU have access to declarations of the State Security Service to verify them and to follow on possible signs of fraud or illicit enrichment.

AntAC sues Security service of Ukraine for e-declarations and demands management of the Security Service of Ukraine to follow the requirements of the corruption prevention law and to submit their asset declarations at the united public portal of e-declarations.
