On Thursday, July 26, at 10.00 the Qualification and Disciplinary Commission of Prosecutors (81-b Melnykova) will hold the meeting regarding the case of Anti-Corruption Prosecutor Nazar Kholodnytskyi. The Commission should decide on the impossibility of Kholodnitskyi’s staying in the office, that will mean his dismissal or reprimand.
The ground for considering the case was complaints against the Anti-Corruption Prosecutor on behalf of NABU Director Artem Sytnyk and the Prosecutor General Yuriy Lutsenko.
In their complaints, they refer to tape recordings made in the office of Kholodnytskyi, where Nazar Kholodnytskyi consulted subjects of criminal cases how to behave during interviews with NABU, informed them about the course of investigations, and provided illegal instructions to prosecutors and violated the norms of ethics regarding communication with subordinates.
In published sections of the conclusion of the member of the Qualification Commission Oleksandr Kovalchuk, who analyzed the complaints of NABU and GPO regarding Kholodnytskyi, it became clear that the member of the QDCP examines the Anti-Corruption Prosecutor’s actions as gross offence. However, Kovalchuk stated that the Commission cannot dismiss Kholodnytskyi, but can only make the reprimand, which is an open manipulation and will enable the later to keep the position of the Anti-Corruption Prosecutor.
There is also a threat that the meeting will not be held at all. Earlier it became known that Kholodnytskyi in court wants to prohibit to use tape recordings from his office as evidence. Thus, the Anti-Corruption Prosecutor may require the Commission not to consider complaints against him without the court decision of the capability of using these tape recordings.
In addition, two days before the meeting regarding the case of the Anti-Corruption Prosecutor, the Commission decided to hold closed meetings. Now the meetings of the Qualification Commission are held behind closed doors, and journalists and public are offered to watch a barely audible live broadcast in the corridor.
